Your Rights & Protections
Title IX of the Education Amendments of 1972 is a federal civil rights law that prohibits sex discrimination in all educational programs and activities receiving federal financial assistance. Under Title IX, discrimination on the basis of sex includes sexual harassment, sexual assault, dating violence, domestic violence, stalking, and discrimination based on pregnancy or parental status.
Supportive Measures
UAS provides supportive measures to individuals who experience sexual harassment or assault, regardless of whether a formal complaint is filed. These measures are designed to restore or preserve equal access to education programs without unreasonably burdening the other party.
Academic Accommodations
Extensions on assignments, class section changes, or temporary leaves of absence.
Living Adjustments
Alternative on-campus housing assignments or room changes.
Safety Measures
No-contact orders, security escorts across campus grounds, or safety planning.
Health Services
Referrals to free mental health counseling, medical resources, and local victim advocacy.
Understanding the Investigation Process
When a formal complaint is filed, the Office of Rights, Compliance, and Accountability (ORCA) coordinates a fair, prompt, and impartial investigation. Both parties (Complainant and Respondent) receive equal rights, including:
- Written notice of all allegations, hearings, and meetings.
- The right to have an advisor of their choice (who may be an attorney) present during interviews and proceedings.
- An equal opportunity to present witnesses and evidence.
- Access to inspect and review all evidence gathered during the investigation.
- A presumption of innocence (not responsible) until a final determination is made at the conclusion of the process.
